24008. It is unlawful to operate any passenger vehicle, or commercial vehicle under 6,000 pounds, which has been modified from the original design so that any portion of the vehicle, other than the wheels, has less clearance from the surface of a level roadway than the clearance between the roadway and the lowermost portion of any rim of any wheel in contact with the roadway.
Amended Ch. 462, Stats. 1984. Effective January 1, 1985.
So I was in the garage looking at my friends truck that I am working on for him. According to this law the lowest portion of the vehicle needs to be higher than the lowest portion of the rim. We are running a 35 series tire on a 22" rim and the vehicle is on air bags. So imagine the tire height from the ground to rim is 1" for those who do not know tire measurements. Does this mean we can legally run this vehicle 1.5" off the ground. I mean I don't even think lane markers are that high. Also According to what I read it is only illegal to operate the vehicle below this standard. If the vehicle is parked and not in operation can it be sitting on the ground with the airbags totally deflated. He just received a violation for this and is trying to fight it. The vehicle was parked in a public parking lot, sitting on the ground. The keys out of the ignition. He was sitting on the hood of the vehicle when the police officer pulled up to him and cited him. I have been helping him look up the vehicle code he was just cited for it. The violation he was cited for is 24008. According to what I read though he was not wrong and should not have been cited. Any input I can get on this would be great. If he is wrong then so be it. I just do not see anywhere in this code that states a parked vehicle has to meet these requirements. Maybe there is another code that was missed and he was cited wrong. Also when I type in altered vehicle codes I receive a lot of responses for low speed vehicles. Maybe I am typing the wrong lingo in the search engine.
