View Full Version : 2 CHP Officers Fired For Shooting Alligator

(CBS 13) SACRAMENTO The California Highway Patrol is terminating two of its officers for shooting and killing an alligator while they were in Louisiana helping with Hurricane Katrina rescue efforts.
According the CHP, two Sacramento region officers will be placed on administrative time-off pending their dismissal. The officers were part of a 116 person team from the CHP sent to Louisiana to help in recovery and recovery efforts in New Orleans after Hurricane Katrina. On approximately September 13th, 2005, the two officers 'discharged' their department issued guns to shoot alligators in a New Orleans bayou. CHP says they believe at least one alligator was killed, a violation of Louisiana state law.
The CHP says the officers are being dismissed after an internal investigation determined that the officers did in fact shoot an alligator and did not report the discharge of their weapons as required by CHP policy.
In a statement released by the CHP, Spokeswoman Fran Clader said, "This is an embarrassment to our department and especially to our personnel who went to Louisiana and served honorably in helping the citizens of that state to recover from the clutches of disaster."
The CHP says they are not releasing the names of the officers because the Louisiana Department of Wildlife and Fisheries in conducting a criminal investigation.

What they dont say, is if there lives were in danger. Personally, I think there is more to this story.

If they discharged their firearms because their lives were in danger, you would have read an MIS highlighting the incident and the next group of officers that went to Louisiana would have been told about it. What the next group of officers was told was NOT to shoot ANY animals. There is always more to the story... and two sides. I'm sure the ones that were there were ordered not to talk about it.

Dayum... sucks to be fired for that.
Not saying that this happened, but it's a common theme in law enforcement where how you act after an incident is often more important than the incident itself.
If you own up to a mistake and take responsibility, it's usually just a verbal reprimand from your sup. But if you lie or it even looks like you're lying, then management comes down HARD.
In a previous life at San Manuel, I took one of the department Crown Vics and did 360s in a dirt lot. A Corporal saw me and then went to a SGT... then it went to the Lt.
I was pulled into the office and the LT. asked what the hell was going on. I said, "I did a 360. It was fun, so I did some more." The LT. looked at me and said that I was honest, took responsibility and told me to not do it again. As I was walking out the Corporal was utterly flabberghasted that nothing happened. That's it. Had I lied it would have been a different story.

As usual the big mistake is having an Alligator Mouth. Just like the guys on LAPD are learning that the camera's are always rolling down there.
Now these guys undoubtedly knew that you can't shoot alligators in Lousiana unless maybe the gator has a kid in its mouth. These officers also knew that you have to tell the man if you discharge your firearm.
So the question is, How did they get caught? Just like Dumb Crooks, they had to talk about it or there were witnesses standing around that they should have known were not trustworthy.

The bottom line is that they are being fired for not reporting it. If they would have reported the incident, they would still have their jobs.

Or, one could say the witnesses saw how screwed up the officers were and rightfully reported the incident for them. Perhaps the officers came forward after some form of realization... albeit late. It doesn't sound like the rank and file will know for some time...

I'm not surprised. The vast majority of those who are fired at the outset of a media blitz are rehired and given back pay.

This came off another board and is by a retired CHP Sgt. who has a very big brain. Interesting and food for thought I believe. I have withheld only his name.
Regarding the suspension of two CHP officers for shooting at alligators while assisting Katrina victims I?d like to make a point or two;
1. They were sworn in as Louisiana State Police Officers and therefore would be subject to the rules and regulations of the LSP and NOT the rules of the CHP ?Palace of Pooh,? or ANY California law.
2. IF they were indicted by some vindictive Louisiana D.A. who has run out of things to do, they would have to be extradited. Hopefully, the Governor Blanco of LA would be too busy to cooperate with CA and Governor Arnold would be just as busy.
3. If the Louisiana D.A. is too busy prosecuting looters, rapists, burglars, robbers, and other local miscreants to bother going after officers who gave up a lot to help the citizens and law enforcement of New Orleans, I don?t see that California or the CHP has any jurisdiction over some infraction that allegedly occurred in LA. You can?t break a California law in Louisiana. And you can?t be prosecuted in California for an offense in Louisiana.
4. If the CHP hasn?t had the time, money, ability, or incentive to find anyone guilty of ?Chief?s Disease? how can it find time, money, and incentive to transport witnesses to this unspeakable crime to any legal venue in California, assuming there actually IS a legal venue in California?
5. How can the charged officers now locate the helpless citizens who were endangered by hungry, displaced, and unpredictable alligators and who were protected by the alleged shooting?
6. Isn?t it still legal to buy alligator boots, wallets, and belts in California?
7. Will the CHP be trying to fire CHP officers who discharge weapons in Iraq and fail to file a report?
8. Is common sense dead?
