I just submitted an application a couple of weeks ago. And I have a question for any background investigators that are here. I am now 34 years old, I was charged with a misdemeanor a few years ago (3 years ago). What I did was really stupid and I have no excuse at all. I am going to be very frank with my story so if you reply please remember that I already agree that it was very stupid. The misdemeanor was for taking a picture under a woman’s skirt with my cell phone. I did it 3 times in the time span of 2 days. I was caught by the 3rd woman. I ran away but my cell was grabbed from me. After getting home I told my wife, and she and I went to the police station and I turned myself in. I gave a confession, but I was not arrested at the time. I had a court date set for nearly 4 months later. About a month after the original incident, I took another picture of the same kind with a phone I was borrowing. I did not get caught, but it made me realize that this could become a continuing problem for me, so I confessed it to my wife and began going to counseling with a church elder. Since then I have not done it again, and I don’t want to do it again. At the court hearing I was told if I completed 24 hours of court appointed counseling that the charges would be dismissed, I also had to go downstairs to be booked and released. I completed the counseling and it was dismissed. I have never had any other brushes with law enforcement. I have had between 2-3 minor tickets in my whole life and the last one was over 12 years ago. I had very limited underage drinking, and smoked marijuana less than 10 times between the ages of 16 and 18. Since the age of 18 I have basically been a straight arrow until this incident. I have had the same job for the past 8 years I have good reviews every year at my job, and I have great credit. I called the recruiters office and asked them if I would automatically be disqualified for this and they said “No, but you will have some explaining to do for the background investigator!” I know no one will be able to tell me definitively whether this would disqualify me or not. My question for any background investigators is this; do you think you would disqualify someone based on this? I know that it was recent and stupid, but I guess I am hoping that since I have tried to take responsibility for my actions and have gone to counseling, first on my own (I still am accountable to a group of guys at my local church by the way), then with the court approved counseling, and with my fairly clean background (other than this), that this won’t be as big a deal as I am scared of it being.
