OK.. So I searched this topic to no avail. My H-6 has nothing on it. I've had 2 speeding tickets and both are off my record because of traffic school. DO I LIST THEM OR NOT? The instructions say list EVERYTHING, but then at the bottom of the page it has a box to check that says you may omit citations that were expunged or sealed...
this is confusing. if i list them and i didnt have to because they were off my record then it will look like i cant follow directions, and if i do not list them they might ask why i didnt when it says to list everything..
just list em'??? this seems to be the idea here.. ??

You must list them. A conviction that was reduced, dismissed, or purged is not the same as sealed or expunged. Also, if you note, it lists very specific sections under which a citation must be sealed or expunged to legally omit it.

I was always under the impression that even expunged arrests needed to be disclosed for LE jobs.
I know for the feds on national security forms it will read something like "list all arrests since 18" and that is regardless of being expunged/sealed.
Also my bro is a PA state trooper and was arrested twice for disorderly conduct (summary offense) at 19 for being underage at a parties, DC was given instead of underage drinking (more serious in PA). During his BI he had to list these charges, is CA different?

There are half a dozen sections under which a conviction may be sealed or expunged. Most come with the caveat, "however you must still disclose this in a law enforcement application" or something similar. A very few however, do not need to be listed.
In all reality, a background investigator will learn of the incident through one means or another and it will be discussed. For example, even though you may not (in that rare case) be obligated to disclose a conviction, you would still have to disclose the incident that lead to the arrest and conviction when asked...
