View Full Version : looking for advice - bizarre traffic incident

Hello Sirs, Maams, Officers, Kind Knowledgable People,

Apologies if this isn't correct forum or if it's way way off topic, but...

I would like to know specifically what personal information is on a traffic incident report.

I was involved in a verbal altercation that turned really bizarre and then scary.
I was cut off right before a red light. Stopped with about 10 feet to spare (I'm new to driving modern cars with ABS). I honked (bad idea).

The driver in front got out w/ cell phone in hand, started yelling racial slurs, said "I'm calling the police, and oh my husband is on his way to beat you up", and to top it off, said "I'm going to make you pay to fix these scratches on my bumper". She continued yelling bad things at me. I'm a bit unnerved and go ask the car behind me if they would stick around to be a witness.

CHP and police arrive. The other driver tells police I was "banging on her window" and that I physically "pushed" her (assault?). She also says I rear ended her car. The Officers talk with the witnesses and see through her story.

In the end a CHP traffic incident is filed.

I'm probably going to give my insurance company a heads up... but

1) I'm concerned about a fraudulent insurance claim against me

2) I'm concerned that my home address is in the report. I may be a bit paranoid here, but the things she was yelling and her threats of "her husband beating me up" is a little un-nerving.

Q:
Is there anyway I can request an alternative address to list on the report (eg a work address)?
since she was threatening me?

Q:
Is there anything I should do to cover myself regarding the insurance fraud.

Sadly, in the end this was all a waste of everyones time and a misuse of CHP and the 911.

The logical side of me says this will all blow over, but...
Do I have any options? Would appreciate any input or advice.

I assume you described to the Officer at the scene what you described to us... Bottom line is that you need to deal with the local CHP office that handled the investigation on this one. Notifying your insurance company is not a bad idea.

If this occured in or around Sunnyvale, most likely it will be the San Jose CHP office.

The Officer at the scene said it's a case of he said she said, but did mention there doesn't appear to be any damage to either car.

I'll contact the CHP office/officer and ask if I can list my work address in lieu of my home address (I really don't want this person knowing where I live - although I suppose thats always availabe thru the DMV)
