Can you give us a very basic explaination of what happened. No details. I've been on days off and so haven't had a chance to read any MIS traffic.

Motor was stopped at intersection. UI driver rear ended Romero, pushed him into the intersection, where he was broadsided.

DUI = Driving Under the Influence. It's a misdemeanor if you're caught before you hurt somebody, and a felony if you injure somebody while DUI.

Thanks Mac. Ya see day one and I've learned something already,I thought any DUI was a felony. Sad to hear about the Officer being killed. Poor guy never even had a chance to try and get out of the way.

So if he gets a misdemeanor isn't that 2 years or less in a county jail?

Don't know about the law wannaBE but if you get yourself a good snake oil salesman as your attorney you beat some charges runnin' backwards.

A misdemeanor is usually a year or less in county jail.

The fact that Officer Romero was killed as a result of the DUI, the suspect is guilty of felony DUI.

I think what SB405 was referring to is the fact that Saldana's license was allegedly suspended from a prior misdemeanor DUI conviction.

Ever notice how when some drunk gets behind the wheel and hits someone it's just about always the poor bastard thats minding his/her own business that ends up getting killed while the drunk many times ends up with minor (if any) injuries. Will these people ever learn?

The woman who hit me had 1 prior conviction for DUI and five prior arrests. She was sentenced to 4 years for Aggrivated assault and DUI (Arizona) It was amusing to hear her tap dance when the judge asked her about each arrest prior to handing down the Maximum.

I also voulnteer with MADD as a speaker and they estimate that 30 percent of offenders that attend a Victim Impact Panel will Get arrested for DUI again. I personally feel that DUI is a violent crime even if no one was hurt (if someone shoots into an occupied school is it any less a violent act if he is a lousy shot and doesn't hit anybody?)

PS note for the officers. MADD doesnt just give out awards for deuce arrests. MADD also offers support services to the victims and victims families of DUI wrecks contact your local MADD and they will give you cards to give to victims and their families. This is a way that you can help the victims even after your part is over.
